Terms of Service

The terms governing use of the Inspection Viewer Inc. website, client portal and inspection services.

01 Acceptance

By accessing this website, creating a portal account or engaging us to perform an inspection, you agree to these terms. If you are agreeing on behalf of a company, you confirm you have authority to bind that company.

02 Scope of an inspection

Each engagement is governed by the accepted proposal, which names the inspection type, the scopes included, the governing standard of practice and the deliverables. Anything not named in the proposal is outside the scope of the engagement.

Unless the proposal expressly states otherwise, inspections are non-invasive and visual, limited to readily accessible areas, and represent the condition of the property on the date of inspection only. An inspection is not a warranty, a guarantee, an insurance policy, or a code compliance certification.

We will not dismantle equipment, move stored belongings, enter areas that are unsafe or inaccessible, or operate systems that are shut down or disconnected. Areas we could not access are recorded as not accessible in the report.

03 Your obligations

You agree to provide accurate property information, arrange access to the property and all areas within scope for the scheduled window, disclose known hazards and prior conditions, and ensure utilities are connected and operational where the scope requires systems to be tested.

Where access is not available on the scheduled date, or utilities are not on, a re-visit fee may apply.

04 Reports and confidentiality

Reports are prepared solely for the named client and for the purpose stated in the proposal. They may not be relied upon by any other party without our prior written consent, and no duty of care is owed to any third party who obtains a report.

You may share a report with your professional advisers, lenders and counterparties in the transaction it was prepared for. You may not republish it, sell it, or use it in marketing without written permission.

We retain copyright in the report and all supporting material.

05 Fees and payment

Fees are as stated on the accepted proposal or the active subscription. Invoices are payable within the terms stated on the invoice. Overdue amounts may attract interest at the lesser of 1.5% per month or the maximum permitted by applicable law.

Where a report has not yet been released and an invoice is overdue, we may withhold delivery until the account is settled.

06 Cancellation and rescheduling

Inspections cancelled or rescheduled with at least twenty-four hours notice incur no charge. Within twenty-four hours, or where our inspector attends and cannot gain access, a mobilisation charge applies.

Subscriptions may be cancelled in accordance with the subscription agreement. Fees already invoiced for a current term are not refundable except where required by law.

07 Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to an engagement is limited to the fees paid for that engagement. We are not liable for indirect, incidental, consequential, special or punitive damages, or for loss of profit, revenue, or opportunity.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud, or for death or personal injury caused by negligence.

Any claim must be brought within one year of the date of the inspection giving rise to it.

08 Acceptable use of the platform

When using the website, portal or applications you agree not to:

  • Attempt to gain unauthorised access to any account, system or data.
  • Probe, scan, or test the vulnerability of the platform without our prior written authorisation.
  • Interfere with or disrupt the service, including by automated scraping or excessive request volume.
  • Upload malicious code, or content you do not have the right to upload.
  • Impersonate any person or misrepresent your affiliation with any organisation.
  • Share account credentials, or allow anyone else to use your account.

We may suspend or terminate access for any breach of this section.

09 Account security

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@inspectionviewer.com if you suspect unauthorised access.

We will never ask for your password by email or telephone. Treat any message that does so as a phishing attempt and report it to us.

10 Governing law

These terms are governed by the laws of the State of GA, without regard to conflict of law principles, and the courts of that state have exclusive jurisdiction over any dispute.
